News Report: The United Kingdom’s Violations of Refugee and Migrant Rights

Introduction

The issue of asylum and migration has long been a contentious topic in the United Kingdom. In recent years, with the increasing number of asylum seekers and migrants, the British government has adopted increasingly stringent policies toward these individuals. These policies have faced severe criticism from human rights organizations and international bodies, raising serious concerns about the violation of fundamental rights of refugees and migrants. This report provides a detailed examination of these violations and aims to shed light on the various dimensions of this issue.

 

Incidents

The Rwanda Deportation Plan

Earlier this year, the UK government approved the Rwanda deportation bill, a draconian law that allows the government to send certain asylum seekers on a one-way flight to Rwanda. This legislation was passed despite strong opposition from the House of Lords, a ruling by the UK Supreme Court, and Britain’s international human rights obligations.

In response, UN experts expressed concerns about the role of the aviation industry and regulatory authorities in facilitating these unlawful transfers under the agreement between the UK and Rwandan governments. They warned that airlines and aviation regulators could become complicit in human rights violations by enabling such deportations. The experts emphasized that transferring asylum seekers to Rwanda or any other country where they may face the risk of refoulement constitutes a violation of the right to be free from torture and other cruel, inhuman, or degrading treatment. They also referenced the UN Guiding Principles on Business and Human Rights, which require aviation regulators, international organizations, and commercial entities to uphold human rights standards. According to Principle 13 of the UN Guidelines, businesses must avoid involvement in human rights abuses, while Principle 23 obligates them to respect international human rights laws. The UK Civil Aviation Authority, alongside the European Union Aviation Safety Agency and international bodies such as the International Air Transport Association and the International Civil Aviation Organization, bears responsibility in this matter.

The UN Refugee Agency (UNHCR) had previously warned UK courts that asylum seekers sent to Rwanda face the risk of refoulement, a concern that was echoed by the UK Supreme Court last year.

While British media reports suggest that the Rwanda plan is being abandoned by the new government, in reality, the Labour Party, despite promising to scrap the scheme, has not ruled out the idea of deporting asylum seekers and migrants to a third country. The party has stated that while Rwanda will not be the chosen destination, another country will be identified for this purpose. The new UK Home Secretary has reaffirmed that establishing a new Border Security Command remains a top priority. Deporting migrants to Rwanda contradicts the UK’s international commitments, and the commodification of asylum seekers, along with violent and degrading treatment, undermines human dignity and is unacceptable.

UK-France Cooperation on Border Control

The UK Labour Party has announced plans to negotiate new agreements with other countries, including France, to expedite migrant removals. The French maritime police, funded by the UK, have been forcing small boats to turn back before reaching British shores—a practice known as “pullbacks.” Investigative reports by The Observer, Lighthouse Reports, Le Monde, and Der Spiegel confirm these actions. Documented videos reveal concerning tactics, including creating large waves near migrant boats, police officers boarding the vessels armed with large pepper spray canisters, and puncturing inflatable boats to disable them. The UK government has paid hundreds of millions of pounds to France for these operations, with funding agreements falling under the Sandhurst Treaty.

Eyewitnesses, including an Indian man, reported that French forces deliberately rammed a migrant boat, causing passengers to fall into the water. A French government official also disclosed that the UK has been exerting “relentless” and “intense” pressure on the French maritime police to prevent migrant crossings. Since 2014, the UK has allocated over £700 million to France to curb irregular migration. In March 2023, then-Prime Minister Rishi Sunak announced that the UK would invest £500 million over three years to fund France’s border enforcement, a new detention center, and additional security equipment. According to a Home Office spokesperson, these measures have reduced last year’s migrant crossings by over one-third.

Discriminatory Immigration Laws

Several UK immigration laws are inherently discriminatory. The Borders Act 2007 and the implementation of Operation Nexus in 2012 have caused widespread fear and uncertainty, particularly among Black residents, including permanent residents and citizens of African descent. These laws permit automatic deportations, removals without criminal convictions, and racial profiling, exacerbating distress among Black communities.

The Nationality and Borders Act 2022 further escalated concerns by allowing citizenship deprivation without prior notice and criminalizing asylum claims.

Detention of Migrants

The UN Human Rights Committee has expressed concern over the detention of migrants in UK immigration centers. Reports indicate that many individuals are held in these facilities for over 28 days. The Illegal Migration Act 2023 has expanded detention powers, particularly for vulnerable groups such as women and children. Pregnant women can now be detained for up to seven days, while undocumented arrivals face automatic 28-day detention without bail or judicial review. The use of GPS tracking for migrants has also been flagged as a major concern by the committee.

The UK government’s immigration policies—particularly the Rwanda deportation plan and its cooperation with France on border control—constitute clear violations of refugee and migrant rights. Discriminatory immigration laws and poor detention conditions further exacerbate the situation. This report highlights how the UK government, by disregarding its international obligations, employs inhumane methods to prevent asylum seekers and migrants from entering the country.

While media reports claim the Rwanda plan is dead, the Labour Party has not ruled out deporting migrants to third countries. Given these developments, it is imperative for international organizations and human rights bodies to intensify pressure on the UK government to reform these policies and uphold the fundamental rights of refugees and migrants.
